Terms and Conditions

Last updated: 23 Mar 2026

These Terms and Conditions ("Terms") apply to your use of the Oakwells website and to any quote, order or benchtop order placed with Oakwells ("we", "us", "our"). By using our website or placing an order, you agree to these Terms.

1. Quotes and product information

Images, colours, slab patterns, finishes and dimensions are provided as a guide only. Natural and manufactured surfaces can vary between batches. Quotes are based on the information available at the time and may be updated if your selections, measurements, scope or site requirements change.

2. Orders

An order is not binding until accepted by us. We may contact you to confirm details, measurements, material selections, delivery arrangements or other specifications before proceeding.

You are responsible for checking that all order details are correct before approval. Any requested changes after approval may result in revised pricing, revised lead times or refusal if production has already progressed.

3. Benchtop orders and material ownership

Unless we expressly state otherwise in writing, benchtop orders submitted through Oakwells are priced and supplied for the finished pieces specified in the order only. Pricing is not based on transferring ownership of the entire slab or unused material remainder to the customer.

Any leftover material, overcuts, offcuts or remnants created during manufacture remain the property of Oakwells, unless a separate written agreement states otherwise. This helps us manage material yield, manufacturing efficiency and future use of remaining stock.

4. Pricing and payment

Prices are in Australian Dollars (AUD). GST treatment will be shown on your quote, invoice or checkout. Delivery, freight, installation, site works and any other additional services are charged separately unless clearly stated as included.

We may require full payment, a deposit, progress payments or payment before dispatch, depending on the type of order. If payment is not received when due, we may pause work, withhold delivery or cancel the order.

5. Changes, cancellations and refunds

If you need to change or cancel an order, contact us immediately. Because many Oakwells products and benchtop orders are custom or cut to specification, changes and cancellations may not be possible once production, cutting or procurement has commenced.

Deposits and payments may be non-refundable once work has commenced, except where required by the Australian Consumer Law.

6. Production and lead times

Any production or delivery timeframe we provide is an estimate only. Delays can occur due to supplier lead times, freight issues, material availability, design changes, site readiness or events outside our reasonable control.

7. Delivery, collection and risk

You must ensure safe and suitable access for delivery or collection. Risk in the goods passes to you upon delivery or collection, whichever happens first. Ownership does not pass until we have received full cleared payment.

You should inspect goods as soon as reasonably possible after delivery or collection and notify us promptly if there is any visible damage, shortage or issue.

8. Installation and site conditions

Unless expressly included, Oakwells supplies products only and does not include installation, plumbing, electrical, structural or other trade works. We are not responsible for issues caused by incorrect measurements, unsuitable site conditions, substrate movement, hidden services, out-of-square walls or third-party workmanship.

9. Natural variation and tolerances

Stone, timber and other surface products may contain natural variation in colour, movement, veining, texture, shade and pattern. Minor production tolerances, joint lines, variation in finish and reasonable batch differences do not constitute a defect where the product is otherwise fit for purpose.

10. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies rights you may have under the ACL.

11. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss. Where liability cannot be excluded and the law permits limitation, our liability is limited to re-supplying, repairing, replacing or refunding the relevant goods or services, at our option.

12. Website content and intellectual property

All content on this website, including text, graphics, logos, images, drawings and layout, is owned by or licensed to Oakwells and must not be copied, reproduced or used without permission.

13. Privacy

We handle personal information in accordance with our Privacy Policy and applicable privacy laws.

14. Governing law

These Terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland.

15. Contact
